Terms of Service

1. About these terms

These terms are an agreement between you and BrightSense Private Limited ("Branly", "we", "us"), a company registered in India (CIN U62013KA2026PTC228550) with its registered office at Building No 46, 1st Floor, 12th Main Rd, Sector 6, HSR Layout, Bangalore South, Bangalore 560102, Karnataka. They cover the Branly website and product. By creating an account or using Branly, you accept these terms. If you use Branly for a company, you confirm that you are allowed to accept these terms on its behalf.

2. The service

Branly asks AI assistants, such as ChatGPT, Google AI Overviews, Google AI Mode, Gemini, Perplexity and Claude, the questions your customers ask. It measures how often your brand is named, where it ranks and what is said about it. It recommends changes and, with your approval, makes those changes on your website. We may improve or change features over time. If we remove something important you rely on, we will tell you in advance.

3. Your account

• Branly is for businesses. You must be at least 18 to use it.
• Give us accurate details and keep them up to date.
• Keep your login safe. You are responsible for what happens under your account. Tell us straight away if you think someone else has used it.

4. Free trial

You can start a free trial without a card. It lasts 14 days and covers one brand and up to five questions on the AI assistants we check. At the end of the trial, your account moves to the free plan unless you choose a paid plan. We may end or change free trials at any time.

5. Paid plans

• Fees. The fees for each plan are shown on our pricing page at the time you buy. Prices are in US dollars unless the pricing page says otherwise.
• Billing. You can pay monthly, quarterly or yearly. Yearly plans are billed in advance for the year.
• Tax. For customers in India, GST is added to the fees at the rate in force.
• Renewal. Your plan renews on its own at the end of each billing period, at the price then shown on the pricing page, until you cancel.
• Cancelling. You can cancel at any time from your account settings or by writing to connect@branly.ai. Cancellation takes effect at the end of the billing period you have already paid for. You keep access until then.
• Refunds. We do not refund fees for unused time in a billing period. If we have charged you in error, tell us within 30 days and we will correct it.
• Enterprise plans. Enterprise plans run on a separate written agreement. Where that agreement and these terms differ, the agreement wins.

6. Changes on your website

This is the part of Branly that acts on your behalf, so we set it out carefully.

• You give access. To make changes, Branly needs access to your website through a CMS login, a plugin or an access key, as agreed with you during setup. You confirm that you have the right to give that access.
• Nothing goes live without your approval. Every change is shown to you first. Branly makes it only after you approve it.
• You stay in charge of your site. You are responsible for your website's content and for making sure it follows the law, including content we add at your request.
• You can undo. We keep a record of each change we make, and we can reverse a change on request. We recommend keeping your own backups.
• You can remove access at any time, from your account settings or by writing to connect@branly.ai. We will stop making changes straight away.

7. What we can and cannot promise

AI assistants are built and run by other companies. They change often, and the same question can get different answers. Our measurements are estimates, and we show how sure we are about each one. We work to give you accurate readings and useful recommendations, but we cannot promise that any change will get your brand named, move it up, or increase your sales.

We do not use tricks to game AI assistants, and you agree not to ask us to.

8. Using Branly fairly

You agree not to:

• use Branly for anything unlawful, or to publish false or misleading claims;
• copy, resell or rent out the service without our written agreement;
• try to access parts of the service you are not meant to, or reverse-engineer it;
• overload or disrupt the service or the systems it connects to.

9. Your data and ours

Your data, your website and its content remain yours. You let us use them only to provide and improve Branly for you. We may use data that is combined and anonymised, so that it cannot identify you or your brand, to improve our methods. Our Privacy Policy explains how we handle personal data.

Branly's software, design, methods and brand belong to us. You may use your reports freely inside your business.

10. Confidentiality

Each of us will keep the other's non-public business information confidential, and use it only for this service.

11. Liability

We provide Branly with reasonable care and skill. Beyond that, to the extent the law allows, we are not responsible for indirect losses, such as lost profits or lost business, or for what AI assistants say. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim, or ₹10,000 for free accounts. Nothing in these terms limits liability that the law does not allow us to limit.

You agree to cover us for losses caused by content you give us, or by access to a website that you were not entitled to give.

12. Suspending or ending the service

You can close your account at any time. We may suspend or close an account that breaks these terms, after warning you where we reasonably can. When an account closes, you can ask us for a copy of your data within 30 days. After that we delete it, as set out in our Privacy Policy.

13. Changes to these terms

If we change these terms, we will update the date at the top. If a change is important, we will tell you by email at least 30 days before it takes effect.

14. Law and disputes

These terms are governed by the laws of India. Any dispute will be handled by the courts in Bengaluru, Karnataka.
